1. Overview

These Terms of Service ('Terms') describe how customers may use Sarpius's hosting, cloud, and infrastructure services. They operate under and in support of the Sarpius User Agreement, which governs the legal relationship between you and Sarpius.

2. Eligibility & Account Use

You must be at least 18 years old or have parental or guardian consent to use Sarpius. Accounts are personal or organizational and may not be shared or resold without written permission. You agree to provide accurate registration details and to keep them up to date.

3. Acceptable Use & Prohibited Activities

You agree to use Sarpius responsibly and in compliance with our Acceptable Use Policy (AUP). Prohibited activities include: • Hosting or distributing illegal, harmful, or copyrighted content without authorization; • Engaging in attacks, spam, or exploitation of security vulnerabilities; • Using excessive or abusive resource loads beyond plan limits; • Hosting cryptocurrency miners or botnets; • Attempting to gain unauthorized access to any system or data. Violations may result in service suspension or termination without refund.

4. Account Security

You are responsible for safeguarding your credentials and securing access to your account. Notify Sarpius immediately if you suspect unauthorized use. We are not responsible for losses caused by compromised credentials or failure to implement basic security practices.

5. Payments & Billing

Your first app runs on the Free Tier at no cost. You may use the Free Tier for any lawful purpose, including commercial use such as a business website or the front-end of a paid product; the same Terms, the AUP and the limits shown on our pricing page apply. Service fees are due in advance as described in your account portal. Payment methods, billing cycles, and pricing are shown during checkout. Unused wallet balance that you paid for is refundable to the original payment method on request; amounts already consumed by active services are non-refundable. We refuse or reverse a refund only in these cases: the balance is promotional, referral or partner credit rather than money you paid us; the underlying payment has been charged back or is under fraud investigation; or paying it out would breach applicable law or sanctions. Late or failed payments may result in suspension or data removal after reasonable notice.

6. Service Modifications & Maintenance

We may improve, modify, or discontinue certain services to enhance stability or performance. Planned maintenance will be announced in advance per our Service Level Agreement (SLA). Emergency updates may occur without notice if required for security or reliability.

7. Customer Data & Backups

You retain ownership of your hosted data. Sarpius does not access your content except as required for maintenance, support, or legal compliance. You are responsible for maintaining your own backups. For how long we retain data after you delete a resource or close your account, see the retention list in our Privacy Policy: hosted content is deleted within 30 days after closure, account data within up to 6 months.

8. Security & Abuse Prevention

Sarpius uses automated systems to detect abuse, malware, and unauthorized activity. You agree not to interfere with these protections. Accounts engaging in abuse may be limited, suspended, or terminated in accordance with our AUP.

9. Service Performance

Sarpius aims to deliver reliable service as described in the SLA. While we strive for continuous uptime, temporary interruptions may occur due to maintenance, hardware failure, or network conditions beyond our control.

10. Suspension & Termination

We may suspend or terminate access to your account if you violate these Terms, the AUP, or any applicable law. We will attempt to provide notice where practical. Upon termination, all data may be permanently deleted after retention periods expire.

11. Identity Verification

To lift a restriction on your account or to reach a higher trust tier, we may ask you to complete identity verification: your name, date of birth, document type and expiry date, and an image of an accepted identity document (passport, national ID card, or driving licence). Identity verification is never required simply to use the platform in general, and completing it is voluntary; if you decline, the restriction or trust tier that already applies to your account stays as it is. The optional selfie-based verification route is not currently offered. See the Privacy Policy's "Identity Verification (KYC)" section for how we handle this data.

12. Third-Party Services

Sarpius may integrate with third-party software, APIs, or infrastructure providers. Such services are subject to their own terms, and Sarpius is not responsible for their reliability or actions.

13. Changes to These Terms

We may update these Terms periodically to reflect service or operational changes. Updates will be announced on our website or by email. Continued use of Sarpius after updates means you accept the revised Terms.
